KAJIAN SOSIOPERUNDANGAN PERKAHWINAN MERENTASI SEMPADAN DI NUSANTARA [SOCIO LEGAL RESEARCH ON CROSS-BORDER MARRIAGE IN THE MALAY ARCHIPELAGO]

Abstract

Latar belakang dan tujuan: Rentetan dari pertambahan bilangan perkahwinan merentasi sempadan dan penyelidikan yang terhad mengenainya, penyelidikan ini telah dijalankan bertujuan untuk membincangkan aplikasi undang-undang dan amalan-amalan dalam perkahwinan merentasi sempadan dalam kalangan Muslim di Malaysia.  

 

Metodologi: Penyelidikan ini telah dijalankan menggunakan pendekatan kajian sosioperundangan dan kaedah kualitatif. Data telah diperoleh melalui sesi temu bual dengan 11 informan yang terdiri daripada pegawai pejabat agama di Malaysia, Pegawai pejabat agama di Selatan Thailand, Pegawai Konsulat Malaysia di Songkhla, Thailand dan juga pasangan-pasangan yang telah mengamalkan perkahwinan merentasi sempadan.  Selain itu, analisis dokumen juga digunakan bagi menganalisis statut dan kes-kes yang diputuskan oleh mahkamah. 

 

Dapatan Kajian: Hasil penyelidikan menunjukkan bahawa amalan perkahwinan merentasi sempadan dalam kalangan Muslim di Malaysia berlaku disebabkan oleh pelaksanaan undang-undang yang begitu ketat di samping tahap keterbukaan pasangan yang terlibat dalam perkahwinan merentasi sempadan dalam menerima perkahwinan merentasi sempadan ini. Kajian juga menunjukkan bahawa ketiadaan peruntukan yang khusus berkaitan perkahwinan merentasi sempadan ini menyebabkan timbul isu perundangan di peringkat global yang perlu diselesaikan melalui instrumen antarabangsa.

 

Sumbangan: Kertas penyelidikan ini merupakan satu permulaan kepada penyelidikan yang lebih terperinci terhadap perkahwinan merentasi sempadan iaitu hasil dari penyelidikan akan akan digunakan sebagai penambahbaikan terhadap peruntukan undang-undang yang sedia di Malaysia pada masa kini.

ABSTRACT

Background and Purpose: Due to the increase in the number of cross-border marriage and limited research available in the area, the paper sets on discussing the application of the related laws and practices that surround cross border marriage among the Muslims in Malaysia.

 

Methodology: This research used the socio-legal approach and qualitative method. The data had been obtained through interviews with 11 informants, consisting of officials of the religious office in Malaysia and in Southern Thailand, officials of the Malaysian Consulate in Songkhla, Thailand as well as couples who practised cross-border marriage. Apart from that, analysis document had been used to analyse statutes and reported cases.

 

Findings:  This research shows that the practice of cross-border marriage among Muslims couples in Malaysia is due to strict implementation of the law and their aceptance and openness in going for cross-border marriage. The lacuna of specific provisions relating to cross-border marriage in the law has led to global legal issues that require resolution using international instruments.

 

Contributions: This article is hoped to pave the way for a more comprehensive study on the cross-border marriage which the findings will be useful to further improve the current legal provisions in Malaysia.

Muhamad Helmi Md Said, Universiti Kebangsaan Malaysia

Muhamad Helmi Md Said is a Senior Lecturer at Faculty of Laws Universiti Kebangsaan Malaysia. He obtained his first degree in LLB (Honours) in 2006 from International Islamic University Malaysia and holds both his Masters in 2008 and his Ph.D in 2017 from International Islamic University Malaysia. He specialises in the area of family Justice including woman and child issues, Procedural Laws (Criminal and Syariah), Private International Laws and Statistics for Legal Studies.

Noraini Md Hashim, Islamic Law Department Ahmad Ibrahim Kulliyyah of Laws International Islamic University Malaysia

Noraini Md Hashim is an Associate Professor at the Islamic Law Department, Ahmad Ibrahim Kulliyyah of Laws, International Islamic University Malaysia. She obtained her first degree in LLB (Honours) in 1991 from International Islamic University Malaysia and holds both her Masters in 1993 and her Ph.D in 2009 from International Islamic University Malaysia. She specialises in the area of family law both for Muslims and non- Muslims, woman and child issues.

Nora Abdul Hak, Legal Practice Department Ahmad Ibrahim Kulliyyah of Laws International Islamic University Malaysia

Nora Abdul Hak, LL.B. (Hons), LL. Bs (Shariah), MCL (IIUM) and PhD (Glasgow Caledonian, Scotland, UK) is a Professor at Ahmad Ibrahim Kulliyyah of Laws, International Islamic University Malaysia. The title of her PhD thesis is ‘Family Mediation and Tahkim (arbitration) in Resolving Family Disputes’. She teaches and researches in Family Law, Islamic jurisprudence, Alternative Dispute Resolution (ADR), Law of Probate and Succession, and Islamic Legal System.

Roslina Che Soh@Yusoff, Islamic Law Department Ahmad Ibrahim Kulliyyah of Laws International Islamic University Malaysia

Roslina Che Soh, DPA (ITM), LL.B. (Hons)(IIUM), MCL (IIUM) and PhD (IIUM) is an Associate Professor at Ahmad Ibrahim Kulliyyah of Laws, International Islamic University Malaysia. Currently, she teaches family law at the undergraduate level and post-graduate diploma level. Her major research interests are in family law, children’s right, women rights and gender issues.

Fauziah Hani Ahmad Fuzi , Federal Court of Malaysia Palace Of Justice, Putrajaya

Fauziah Hani binti Ahmad Fuzi, currently is a Deputy Registrar of the Federal Court of Malaysia. Before the current position, she held various posts in the Malaysian Judiciary such as Senior Assistant Registrar and Magistrate in various courts i.e. Magistrate Court, High Court, and the Court of Appeal. She completed her LLB in 2006, her second degree in LLB_S in 2007 and her Master in Comparative Law in the following year, 2008, all from International Islamic University, Malaysia. She had also obtained her doctorate from the same university in 2019.

Khairulshuhadah Yaakob, Court of Appeal of Malaysia Palace Of Justice, Putrajaya

Khairulshuhadah binti Yaakob currently is a Deputy Registrar of the Court of Appeal Malaysia.
