Proses kafa’ah pada kebiasaannya berlaku sebelum perkahwinan untuk memilih calon pasangan yang sekufu dalam pembentukan institusi kekeluargaan yang kukuh. Ini diakui dan dibahas oleh para fuqaha yang mana bertujuan untuk mengelak berlakunya pertelingkahan, pembubaran dan perceraian dalam rumahtangga. Adapun di Negara Brunei Darussalam masih menjadi isu tertinggi dalam statistik kes aduan rumahtangga Bahagian Khidmat Nasihat Rumahtangga (BKNK), Jabatan Hal Ehwal Syariah (JHES), Kementerian Hal Ehwal Ugama (KHEU), atas sebab tiada persefahaman suami dan isteri yang berjumlah 4282 kes (tahun 2016-2021) daripada sebab-sebab kes aduan yang lain. Jadinya penelitian kajian ini membincangkan konsep kafa’ah dalam maqasid syariah termasuklah kriteria-kriteria kafa’ah mengikut empat madhahib dan hubungannya dengan perkembangan konteks isu-isu semasa di Negara Brunei Darussalam. Adapun penggunaan kajian ini adalah kaedah kualitatif yang merangkumi kaedah temubual daripada pegawai-pegawai BKNK, JHES, KHEU, analisis dokumen-dokumen dan kes-kes aduan fail BKNK, JHES, KHEU dan pengumpulan data-data dan maklumat daripada kajian perpustakaan.
The process of kafa'ah typically occurs before marriage to choose a compatible partner for the formation of a strong family institution. This concept is recognized and discussed by Islamic jurists (fuqaha) with the aim of preventing disputes, dissolution, and divorce in households. In Brunei Darussalam, it remains a significant issue, as reflected in the statistics of family dispute cases from the Family Counselling Service Division (BKNK), Sharia Affairs Department (JHES), Ministry of Religious Affairs (KHEU), totalling 4282 cases (2016-2021) due to various reasons. Therefore, this research discusses the concept of kafa'ah within the framework of Sharia objectives (maqasid syariah), including the criteria of kafa'ah according to the four madhahib (Islamic schools of thought) and its relevance to the development of current issues in Brunei Darussalam. The research methodology employs a qualitative approach, including interviews with officials from BKNK, JHES, KHEU, document analysis.
