KEDUDUKAN WANITA DALAM ISLAM DAN PERLINDUNGAN NEGARA TERHADAP MEREKA DI NEGARA BRUNEI DARUSSALAM [THE POSITION OF WOMEN IN ISLAM AND NATIONAL PROTECTION AGAINST THEM IN THE COUNTRY OF BRUNEI DARUSSALAM]

Wanita itu adalah tiang negara, jikalau wanita itu baik, maka baiklah negara dan jika mereka rosak, rosak pula sesebuah negara. Islam telah memberikan perhatian khusus terhadap wanita melalui syariahnya dan negara pula wajib melaksanakannya melalui peruntukan undang-undang, peraturan, fatwa dan polisi. Kertas kerja ini membincangkan tentang kedudukan wanita dalam Islam di samping hak mereka dalam konteks moden seperti keterlibatan wanita dalam alam pekerjaan, pelantikan hakim wanita, penglibatan wanita dalam kepimpinan negara, hak janda dan balu, hak pendidikan wanita dan berbagai isu lain yang berkaitan. Kesemuanya dikembalikan kepada perspektif Islam di samping melihat perlindungan yang diberikan oleh Negara Brunei Darussalam terhadap mereka. Kajian ini menggunakan kaedah kepustakaan untuk mendapatkan data-data berkaitan Islam dan wanita. Dokumen-dokumen yang berkaitan dengan isu-isu wanita dalam Negara Brunei Darussalam juga dianalisis untuk melihat perlaksanaan perlindungan terhadap mereka dalam konteks semasa. Kajian ini mendapati bahawa wanita mempunyai kedudukan yang istimewa dalam Islam dan Negara Brunei Darussalam mempunyai pendirian yang berlandaskan syarak dalam melindungi wanita dalam berbagai aspek sama ada di peringkat kebangsaan mahupun antarabangsa.
Women is the pillar of country. If the women are good, then the country is good and if they are broken, the country is also broken. Islam has given special attention to women through its sharia and the state is obliged to implement it through the provision of laws, regulations, fatwas and policies. This paper discusses the position of women in Islam in addition to their rights in the context of modernisation, such as the involvement of women in the workplace, the appointment of women judges, the involvement of women in national leadership, the rights of widows, women's education rights and various other related issues. All of them were returned to the perspective of Islam in addition to seeing the protection provided by Brunei Darussalam towards them. This study uses library methods to obtain data related to Islam and women. Documents related to women's issues in Brunei Darussalam were also analyzed to see the implementation of protection against them in the current context. This study found that women have a special position in Islam and Brunei Darussalam has a stance based on sharia in protecting women in various aspects whether at the national or international level.
