Abstract

This study will present a model of using prohibited sources (muharramat) in case of darurah. The model will guide the victim of darurah to the method of use as required by syariah. As a qualitative study, it will analyze the contents of the classical fiqh text about the category of muharramat and hierarchy of prohibited resources such as pigs, carcasses, blood and alcohol. Re-analysis of this contents is very important in achieving the objective of the study, which is how to use muharramat when it comes today. This is because food technology had produced several food products from prohibited sources such as gelatin, blood plasma, glycerin and alcohol that are widely used today. Indirectly, some of these products should also be included in the current discussion on darurah. Thus, the position of each different muharramat will be analyzed in terms of its category, domination and haram-effects in the context of Islamic law. Hence, this study has found that the categorization of haram muttafaq ‘alayhi and mukhtalaf fihi is more relevant as a new medium in restructuring of various contemporary prohibited sources in food. As a result, this study succeeded in reconstructing a Hierarchy Model of Using Prohibited Food in Darurah which can be used as a guide by Muslim consumers.

 

Kajian ini akan mengemukakan sebuah model penggunaan sumber haram (muharramat) ketika darurah. Model tersebut akan memandu mangsa darurah (mudtarr) kepada kaedah penggunaan muharramat yang selari dengan syariah. Kajian ini berbentuk kualitatif yang akan menganalisis kandungan teks fiqh silam mengenai pembahagian muharramat dan hierarki penggunaan klasik sumber haram seperti babi, bangkai, darah dan arak. Penganalisisan semula amat penting bagi mencapai objektif kajian iaitu menetapkan cara penggunaan muharramat ketika darurah masa kini. Hal ini disebabkan, kejayaan teknologi hari ini menghasilkan beberapa produk makanan daripada pelbagai sumber haram seperti gelatin, plasma darah, gliserin dan alkohol yang digunakan secara meluas. Penggunaan sebahagian produk tersebut juga perlu dibahaskan dalam kes darurah semasa. Maka, kedudukan setiap muharramat yang berbeza akan dianalisis daripada segi kategori, dominasi dan kesan haramnya dalam konteks hukum Islam. Justeru itu, kajian ini telah mendapati pengkategorian haram muttafaq ‘alayhi dan mukhtalaf fihi lebih releven sebagai medium baharu dalam penstrukturan semula pelbagai sumber haram kontemporari dalam makanan. Hasilnya, kajian ini berjaya membangunkan sebuah Model Hierarki Penggunaan Muharramat Dalam Makanan Ketika Darurah yang boleh menjadi panduan kepada para pengguna Islam.
